aws (including the General Data Protection Regulation - “GDPR”), with full transparency.
 

The purpose of this Privacy Policy is to inform you, as clearly and comprehensively as possible, about how your personal data is processed, whether you are a customer or a simple visitor to the website. 

1. Who processes your data? 

The data controller is MARTINE COSMETICS S.A. (chemin du Blanc Caillou, 4/11 - 1420 Braine-l’Alleud - Belgium  Intra-EU VAT No. BE0732 998 712 - RPM Nivelles). 2. What data is collected?
 

2.1. Data you provide to us for the purpose of supplying products 

  • identification data (to open an account or place an order without creating an account): your last name, first name and email address 

  • shipping information: mailing addresses for shipping and billing, phone number 

  • payment information 

The mandatory or optional nature of the data (for example, to fulfill your orders or to open and manage your account, if applicable) is indicated by an asterisk at the time of collection. Please note that we will be unable to process your orders if you do not fill in the required fields. 

2.2. Data collected automatically when you access our site (using cookies, log files, web beacons, tags or pixels): connection and browsing data (your chosen language, time zone, contact identifiers, IP address, browser type and version, referring domain and pages visited, search terms, and how you interact with the site).

3. For what purposes and on what legal bases is your data processed? 

Your data is collected and processed for the following purposes: 

  • to provide you with the products you have ordered, as part of the performance of the contract or to take pre-contractual measures (account creation and management, delivery of ordered products, commercial and accounting management of orders, handling of complaints and unpaid invoices, etc.);  

  • for reasons which fall within the legitimate interests of MARTINE COSMETICS: 

- to improve the quality and suitability of the products we offer you; 

- to improve our communication with you; 

- to analyze data (including website traffic statistics, tracking of open rates, click-through rates, and bounce rates at the individual level, as well as statistics derived from previously anonymized data). 

In this context, we will ensure that a balance is respected between our legitimate interest and the protection of your privacy.  

  • with your consent: to send you our newsletters or information about our products, and for cookies that are not strictly technical or functional, provided that you have the right to withdraw your consent at any time (see Section 8 below).  

  • to comply with the legal and regulatory obligations to which we are subject, particularly with regard to labor law and accounting and tax obligations, as well as personal data protection.
     

4. How long is your data retained? 

Your personal data is retained for as long as necessary for the purposes indicated at the time of collection (for cookies, see the specific retention periods mentioned in our Cookie Policy. When your data is used to provide you with our products, it is retained until the expiration of the legal limitation period or any other retention period required by law. 

5. Who is your data transferred to? 

MARTINE COSMETICS undertakes not to sell, rent, or transfer your data to third parties. In order to provide our products, we may need to share your data with subcontractors or partners. 

5.1. Service Providers  

To ensure the proper functioning of our website and to fulfill your orders, we rely on specialized partners who act as subcontractors. These partners are contractually bound to us and must therefore follow our instructions, maintain the confidentiality of the data they receive and may under any circumstances use it for any purpose other than performing services on our behalf. 

5.2. Partners 

With your consent or whether justified by a legitimate interest, MARTINE COSMETICS may transfer certain of your data to business partners, who act as “data controllers” with respect to the processing of your data.

6. How is your data secured? 

To best protect your personal data, MARTINE COSMETICS has implemented appropriate technical and organizational security measures to prevent the destruction, loss, misuse, alteration, modification, unauthorized access or disclosure of this information. We use industry-standard SSL encryption to protect data transmissions and also safeguard your personal data against unauthorized access through access control procedures, firewalls, and physical security measures.  

It is also important that you cooperate with these security measures, in particular by preventing unauthorized access to your username and password. 

7. Transfer to third countries 

Your personal data will only be transferred or disclosed to processors or data controllers outside the European Economic Area to the extent permitted by law. 

Where applicable, appropriate measures will be taken to ensure that your personal data is meaningfully protected and that such disclosures or transfers are lawful and legitimate. If a disclosure or transfer takes place to a country not recognized by the European Commission as offering an adequate level of protection, such disclosure or transfer will be subject to the conclusion of standard contractual clauses as established by the European Commission or the adoption of binding corporate rules.

8. What are your rights and how can you exercise them? 

You have the right to access, rectify, erase, and transfer your data. Under certain conditions, you also have the right to object to the processing of your data or to have such processing restricted. These rights are free of charge and may be exercised at any time. 

  • Right of access: you have the right to access the data concerning you and to receive a copy of it. 

  • Right to rectification: you have the right to have inaccurate or outdated data corrected. We take all reasonable measures to ensure that the data we hold is up to date and to delete data that is found to be inaccurate or is no longer necessary for processing. If you have an account, you can directly correct or update the data contained therein.   

  • Right to erasure (“right to be forgotten”): under certain circumstances (for example, when the data being processed is no longer necessary for the purpose of the processing), you have the right to ask us to delete it. 

  • Right to restriction of processing: you may request that the processing of your data be restricted, in which case your data will no longer be processed (but will be retained) 

  • Right to data portability: you have the right to receive the data you have provided to us in a structured, commonly used and machine-readable format. 

  • Right to object: when the processing of your data is based on a legitimate interest of MARTINE COSMETICS, you have the right to object to such processing at any time, for reasons related to your particular situation. In this case, however, MARTINE COSMETICS will have the right to oppose legitimate and compelling grounds for continuing the processing. Please note that you have the right to object, at any time and free of charge, to the processing of your data for marketing purposes (direct marketing), and no exceptions may be raised against you. This also includes the right to object to profiling to the extent that it is related to such marketing.  

  • Withdrawal of consent: when the processing by MARTINE COSMETICS is based on your consent, you may withdraw it at any time. Such withdrawal will not affect the lawfulness of the processing of your data carried out prior to the withdrawal.
     

In the context of prospecting (direct marketing), this means that you can unsubscribe from newsletters and other marketing communications at any time by contacting us at contact@martinecosmetics.com or by clicking the unsubscribe link at the bottom of each email.  

  • Right to object to processing based solely on automated decision-making (which includes profiling), when such decision-making has legal effects or significantly affects you. 

We do not make any fully automated decisions that have legal or significant effect on you. 

Our processor Shopify uses limited automated decision-making to prevent fraud, which has no legal or significant effect on you. 

The services that include elements of automated decision-making are as sollocs: 

  • a temporary blacklist of IP addresses associated with repeated transaction failures (which lasts for a few hours); 

  • a temporary blacklist of credit cards associated with blacklisted IP addresses (which lasts for a few days).

To exercise your rights, simply send an email to contact@martinecosmetics.com. Any request regarding your rights must include your full contact information (last name, first name, email address, full mailing address) and be accompanied by a copy of both sides of your ID card to prevent abuse and ensure the security of your data. 

9. Where can you file a complaint regarding the processing of your data?  

If you believe that there is a violation of personal data protection legislation, you can lodge a complaint with the Belgian Data Protection Authority:

10. Protection of minors 

You must be at least 18 years old to place an order on our website. 

If you are informed that your child has provided us with personal information without your consent, please notify us at contact@martinecosmetics.com.  We do not knowingly collect personal information from minors. If we learn that a minor has provided us with personal information, we will take the necessary steps to delete that information and close the minor's account within a reasonable time.
